The Landmark Real Estate Agent Commission Rule Change

Jul 10, 2024 | Agents, Buying, Selling

The National Association of REALTORS® (NAR) has introduced a significant update to the Multiple Listing Service (MLS) regulations, effective August 17, 2024. The rule changes will transform the traditional agent commission structure radically. This change ends the practice of listing agents offering commissions to buyers’ agents through the MLS. It also mandates that buyers’ agents obtain a signed contract from their clients before starting home tours. This update, part of a larger settlement including a $418 million payment by NAR, ushers in a new era of pricing competition and market transparency.

Transforming Agent Commission Dynamics

Historically, the MLS has been crucial for property listings, providing a system for listing agents to pay buyers’ agents through commissions shown on the MLS. This setup ensured a fixed commission for buyers’ agents. The new rule, however, aims to revamp this setup entirely.

In March, NAR committed to a new MLS rule that bans the communication of compensation offers through the MLS. However, it allows these offers to remain an option off-MLS. This would include direct negotiations and consultations with real estate professionals.

The goal is to enhance transparency and flexibility, potentially reducing transaction costs. This could benefit consumers by encouraging more competitive pricing.

Buyers’ Agents: Entering a New Era

This rule change challenges the previous certainty around commission expectations. Yet, it also empowers buyers’ agents to demonstrate their value to both buyers and sellers. Agents must now negotiate commissions through a contract before showing any properties. NAR mandates that MLS participants engaging with buyers secure written agreements prior to home tours, viewing this requirement as an opportunity for agents to detail their professional expertise and the value they provide.

Likely Homebuyer Advantages

Homebuyers are likely to gain from this rule through a competitive market that may lower agent commission fees. This potential reduction could prompt sellers to decrease their listing prices, thereby making homeownership more accessible and bringing the dream of owning a home within reach for many.

A Flexible, Consumer-Empowered Approach

NAR’s rule change takes a bold step toward fostering increased competition and transparency in the real estate market. This shift towards a model that supports individual negotiation over buyer’s agent commissions outside of the MLS points to a more adaptable and consumer-driven industry.

For everyone involved in the real estate market—seasoned investors, first-time homebuyers, or industry professionals—the updated commission rules promise significant savings and new opportunities in the current real estate landscape.
